Terms of Service

By accessing or using the TMG Project Planner and Document Management System (DMS) (collectively, the “Services”), you agree to be bound by these Terms of Service (“Terms”). If you do not agree, you must not use the Services.

3. Eligibility
You represent that you are at least eighteen (18) years old or are authorized to use the Services on behalf of an organization.
4. Description of Services
TMG provides web-based tools for project planning, document management, and internal business workflows. The Services are intended solely for authorized business use.
5. Account Registration & Authentication
Access to the Services requires authentication using approved credentials, including third-party identity providers such as Google OAuth. You are responsible for maintaining the confidentiality of your account and for all activities that occur under your account.
6. Acceptable Use
You agree not to:
- Access systems, accounts, or data without authorization
- Bypass or attempt to defeat security controls
- Upload malware, malicious scripts, or harmful content
- Disrupt service availability or integrity
- Use the Services for illegal, fraudulent, or abusive purposes
- Reverse engineer or exploit the Services
7. Data & Privacy
Your use of the Services is governed by our Privacy Policy, which is incorporated into these Terms by reference.
8. Intellectual Property
All intellectual property, including software, designs, logos, and documentation, is the exclusive property of The Mihalik Group, LLC. You are granted a limited, non-exclusive, non-transferable license to use the Services.
9. User Content
You retain ownership of content you submit. By submitting content, you grant TMG a limited license to store, process, and display such content solely to provide the Services.
10. Service Availability
The Services are provided on an “as available” basis. TMG does not guarantee uninterrupted or error-free operation and may modify or suspend the Services as necessary.
11. Termination
TMG may suspend or terminate access if you violate these Terms, present a security risk, or if required by law. Certain data may be retained to meet legal and security obligations.
12. Disclaimer of Warranties
THE SERVICES ARE PROVIDED “AS IS” AND “AS AVAILABLE” WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED.
13. Limitation of Liability
To the maximum extent permitted by law, TMG shall not be liable for indirect, incidental, or consequential damages. Total liability shall not exceed the amount paid, if any, for use of the Services.
14. Indemnification
You agree to indemnify and hold harmless TMG from any claims arising from your misuse of the Services or violation of these Terms.
15. Governing Law
These Terms are governed by the laws of the State of Illinois, without regard to conflict-of-law principles.
16. Changes to Terms
TMG may update these Terms at any time. Continued use of the Services constitutes acceptance of the updated Terms.
